Terms of Service

Last updated: October 16, 2026

1. Overview

This website is operated by ITEagle Europe, a trading name of Handelsonderneming S.D. Broekhoven, a business established in the Netherlands.

Throughout these Terms of Service, the terms "we", "us" and "our" refer to ITEagle Europe.

By accessing our website, using our services, or purchasing products from our store, you agree to these Terms of Service, insofar as they are applicable and legally enforceable.

These terms apply to all visitors, customers, and other users of our website and services.

Nothing in these Terms of Service excludes or restricts mandatory rights granted to consumers under applicable law.

2. Products and Product Conditions

ITEagle Europe primarily trades in second-hand goods, refurbished electronics, computer components, gaming equipment, collectibles, and related products.

Unless explicitly stated otherwise, products may have been previously used and may exhibit cosmetic wear, signs of aging, or other characteristics reasonably associated with second-hand goods.

Products are sold according to the condition and specifications stated in their individual listings.

We distinguish between products offered in working condition and products sold as defective, untested, incomplete, or intended for repair or parts.

Customers are responsible for reviewing the product description, condition classification, photographs, and any disclosed defects before purchasing.

3. Products Sold for Parts, Repair, or as Untested

Products explicitly classified as "For Parts or Repair", "Untested", "Defective", "Not Working", "As-Is", "Salvage", or similar classifications are offered with the understanding that they may not be operational, complete, reliable, or suitable for immediate use.

Such products may contain known or unknown defects, including electrical, mechanical, structural, or software-related faults.

Unless explicitly stated otherwise, no representation is made that these products are suitable for normal operation or immediate integration into other equipment.

By purchasing products in these classifications, the buyer acknowledges that:

  • The product may require professional inspection, servicing, repair, or replacement of components before use.

  • Additional defects may exist beyond those explicitly identified in the product description.

  • Testing, repair, installation, modification, and operation may involve risks, including damage to connected equipment, data loss, electrical faults, or personal injury.

  • The buyer is responsible for assessing whether the product can be safely inspected, repaired, installed, or operated.

  • Such products should not be connected to valuable equipment, critical systems, or electrical power supplies without appropriate safety assessments.

To the maximum extent permitted by applicable law, all testing, repair, modification, installation, and use of products sold under these classifications is undertaken entirely at the buyer's own risk.

ITEagle Europe excludes liability, to the extent permitted by law, for damage arising from the testing, repair, modification, installation, or use of such products, including damage to other equipment, components, software, stored data, or property.

This exclusion does not apply to liability that cannot legally be excluded, including mandatory product liability, liability for death or personal injury where exclusion is prohibited, or the seller's statutory obligations regarding product conformity and safety.

A product's condition classification does not exempt ITEagle Europe from responsibility for the accuracy of its description or for any mandatory consumer rights.

4. Product Information and Accuracy

ITEagle Europe makes reasonable efforts to ensure that product descriptions, photographs, specifications, compatibility information, availability, and other information published on our website are accurate and up to date.

However, information may occasionally contain typographical errors, technical inaccuracies, omissions, outdated specifications, or other unintended mistakes.

Website content is provided for general informational purposes and should not automatically be regarded as a technical certification, professional recommendation, or guarantee of suitability for a particular application.

No independent contractual rights may be derived solely from general informational content published on our website, except where such information forms part of a binding agreement or creates rights under applicable law.

Product descriptions, explicitly advertised characteristics, and statements that are legally binding remain subject to applicable consumer protection and contractual obligations.

We reserve the right to correct errors, update information, and modify website content without prior notice, provided that such changes do not unlawfully alter existing agreements.

5. Compatibility and Technical Suitability

Unless explicitly guaranteed in writing, ITEagle Europe does not warrant that products will be compatible with every hardware configuration, operating system, software environment, peripheral device, or third-party component.

Customers are responsible for verifying compatibility with their intended applications before purchasing.

For second-hand computer components, electronic equipment, and legacy hardware, compatibility may depend on factors outside our control, including firmware versions, manufacturer restrictions, software updates, motherboard revisions, and existing system configurations.

To the extent permitted by law, we accept no liability for losses resulting from an incorrect compatibility assessment made by the customer where no inaccurate or misleading compatibility information was provided by us.

6. Limitation of Liability and Consequential Damages

To the fullest extent permitted by applicable law, ITEagle Europe shall not be liable for indirect, incidental, special, consequential, or purely economic losses arising from the purchase, possession, installation, operation, malfunction, or use of products purchased from our store.

This limitation includes, where legally permissible:

  • Loss of profits, revenue, business opportunities, or anticipated savings.

  • Business interruption, operational downtime, or production delays.

  • Loss, corruption, or unavailability of data, software, or digital content.

  • Damage to other equipment, connected devices, or associated systems.

  • Costs of substitute equipment, replacement services, recovery operations, or additional technical assistance.

  • Other indirect or consequential financial losses.

For transactions with business customers, our total contractual liability shall, to the extent permitted by law, be limited to the amount paid for the specific product giving rise to the claim.

For consumer transactions, any limitation of liability applies only insofar as it is permitted under mandatory consumer protection legislation.

Nothing in these Terms of Service shall exclude or limit liability for fraud, intentional misconduct, gross negligence where exclusion is prohibited, mandatory product liability, or any other liability that cannot lawfully be excluded or restricted.

7. Installation, Modification, and Improper Use

Customers are responsible for ensuring that purchased products are installed, operated, maintained, and handled in accordance with applicable safety requirements and manufacturer recommendations.

Where legally permissible, ITEagle Europe shall not be responsible for damage resulting from:

  • Incorrect installation or connection.

  • Unauthorized modifications or repairs.

  • Use outside manufacturer specifications.

  • Incorrect voltages, power supplies, or electrical configurations.

  • Improper handling, storage, or transportation after delivery.

  • Negligent, reckless, or otherwise unsafe use.

  • Continued operation after discovering an apparent defect or unsafe condition.

These exclusions do not affect liability arising from defects, inaccurate instructions, or other circumstances for which we remain legally responsible.

8. Orders and Acceptance

Submitting an order constitutes an offer to purchase the selected products.

An automated order confirmation acknowledges receipt of the order and does not necessarily constitute final acceptance where applicable law permits otherwise.

We reserve the right to decline or cancel orders for legitimate reasons, including suspected fraud, payment failure, stock discrepancies, export restrictions, or significant and obvious pricing errors.

Where an order is cancelled after payment has been collected, the applicable payment will be refunded to the original payment method.

We will not unilaterally modify the essential terms of an accepted consumer order without a lawful basis.

9. Pricing, Payments, and Taxes

Prices are displayed in the currency indicated at checkout.

Applicable taxes and shipping charges will be displayed or calculated during checkout in accordance with relevant legal requirements.

For international orders, customers may be responsible for customs duties, import taxes, brokerage charges, or other fees imposed by authorities in the destination country, unless explicitly stated otherwise.

Payments must be completed through the payment methods offered by our store.

We reserve the right to correct obvious pricing or calculation errors subject to applicable law and the customer's contractual rights.

10. Shipping and Delivery

We make reasonable efforts to dispatch orders within the handling times communicated on our website.

Estimated delivery dates are indicative unless expressly guaranteed or otherwise required by law.

Delivery may be affected by carriers, customs authorities, weather conditions, international restrictions, and other circumstances outside our reasonable control.

Responsibility for the risk of loss or damage during transportation shall transfer in accordance with applicable law.

For consumer purchases, the risk generally remains with ITEagle Europe until the customer, or a third party designated by the customer other than the carrier, has taken physical possession of the goods, subject to applicable legal exceptions.

11. Returns, Refunds, and Consumer Rights

Returns and refunds are governed by our separately published Return & Refund Policy, available on our website.

That policy forms part of these Terms of Service, insofar as legally enforceable.

Customers retain all mandatory statutory rights, including applicable withdrawal rights, conformity guarantees, and remedies for defective or incorrectly described goods.

No provision in these Terms of Service or our Return & Refund Policy shall restrict rights that cannot lawfully be excluded.

12. Product Warranties

Any voluntary or commercial warranties offered by ITEagle Europe will be explicitly identified in the relevant product listing or accompanying documentation.

Unless otherwise stated, no additional voluntary commercial warranty is provided.

This does not exclude, shorten, or otherwise restrict statutory conformity rights applicable to consumer purchases.

The nature, age, disclosed condition, and intended purpose of second-hand, defective, or repair-classified products may be relevant when determining the characteristics a buyer may reasonably expect, subject to applicable law.

13. Intellectual Property

Unless otherwise stated, website content, including original product photographs, written descriptions, graphics, branding, and other original materials, is owned by ITEagle Europe or used under appropriate authorization.

Unauthorized reproduction, commercial redistribution, or use of protected material is prohibited unless permitted by law or by an applicable license.

Content explicitly released under an open-source or Creative Commons license remains governed by the relevant license terms.

Third-party trademarks and product names remain the property of their respective owners.

14. Third-Party Services and Links

Our website may contain links to external websites, payment providers, shipping services, or other third-party resources.

We do not control independently operated third-party websites and cannot guarantee their availability, accuracy, security, or content.

To the extent permitted by law, ITEagle Europe is not responsible for losses arising solely from the independent actions or omissions of third-party providers for which we bear no legal responsibility.

15. Prohibited Uses

Users must not use our website or services for unlawful, fraudulent, abusive, or otherwise prohibited activities.

This includes attempts to compromise website security, interfere with store operations, submit fraudulent orders, or misuse our intellectual property.

We reserve the right to restrict access, reject orders, or take appropriate legal action where legitimate grounds exist and applicable law permits.

16. Force Majeure

To the extent permitted by applicable law, ITEagle Europe shall not be liable for delays or failures caused by extraordinary circumstances beyond our reasonable control that cannot legally be attributed to us.

Such circumstances may include natural disasters, armed conflicts, governmental restrictions, major infrastructure failures, or other qualifying events.

This provision does not eliminate mandatory consumer remedies or legal obligations concerning delivery, cancellation, or reimbursement.

17. Changes to These Terms

We reserve the right to update or revise these Terms of Service.

Updated terms will be published on our website with a revised effective date.

Changes shall not retroactively alter the conditions of an already concluded purchase agreement without a valid legal basis.

For an individual order, the version applicable at the time the agreement was concluded shall generally remain applicable.

18. Governing Law and Disputes

These Terms of Service and any agreements concluded with ITEagle Europe shall be governed by the laws of the Netherlands.

For consumers residing outside the Netherlands, this choice of law does not deprive them of mandatory protections granted by the law of their country of habitual residence where applicable conflict-of-law rules provide such protection.

Disputes shall be submitted to the competent courts in accordance with applicable jurisdictional rules.

For business-to-business transactions, disputes shall, where legally permissible, be submitted to the competent court in the Netherlands.

19. Severability

If any provision of these Terms of Service is found to be invalid, unlawful, or unenforceable, the remaining provisions shall continue to apply insofar as legally possible.

An invalid provision shall not automatically invalidate the entire agreement.
